1. Introduction

Welcome to Author's Forge. These Terms of Service ("Terms") govern your access to and use of Author's Forge, a writing software platform operated by Authors Forge LLC ("Company," "we," "us," or "our").

By accessing or using Author's Forge, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Description of Services

Author's Forge is a local-first writing software platform designed specifically for authors. Our services include:

• • Desktop writing application for Mac, Windows, and Linux
• • Book and manuscript organization tools
• • Export functionality (EPUB, PDF, DOCX, Markdown)
• • Import functionality with AI-powered chapter detection
• • AI-assisted writing features (premium)
• • AI-powered spellcheck and grammar tools (premium)

3. User Eligibility

To use Author's Forge, you must:

• • Be at least 18 years of age
• • Have the legal capacity to enter into these Terms
• • Not be prohibited from using the services under applicable law

Our services are primarily designed for users in the United States and Canada. If you access Author's Forge from other locations, you do so at your own risk and are responsible for compliance with local laws.

4. Account Registration

To access certain features, you may need to create an account. You agree to:

• • Provide accurate, current, and complete registration information
• • Maintain and promptly update your account information
• • Maintain the confidentiality of your account credentials
• • Accept responsibility for all activities under your account
• • Notify us immediately of any unauthorized use of your account

Accounts that remain inactive for twelve (12) consecutive months may be suspended or terminated after thirty (30) days' notice.

5. Payments and Subscriptions

The core writing features of Author's Forge are free. Premium features, including AI-assisted writing tools, require a paid subscription.

5.1 Subscription Terms

• • Subscriptions are billed on a recurring basis (monthly or annually)
• • By subscribing, you authorize us to charge your payment method automatically
• • Subscriptions automatically renew unless cancelled before the renewal date
• • You may cancel your subscription at any time through your account settings

5.2 Refund Policy

Subscription fees are generally non-refundable. Upon cancellation, you will retain access to premium features until the end of your current billing period. Core writing features and your content remain accessible regardless of subscription status.

6. User Content

6.1 Ownership

You retain all ownership rights to the content you create using Author's Forge, including manuscripts, notes, outlines, and any other written material. Your words are yours.

6.2 License Grant

By using our services, you grant Authors Forge LLC a worldwide, non-exclusive, royalty-free license to use, process, and display your content solely for the purpose of providing and improving our services. This license is limited to what is technically necessary to operate the platform.

6.3 Content Responsibility

You are solely responsible for your content, including ensuring you have the rights to any material you import, and for maintaining backups of your work.

7. AI Features and Third-Party Services

Author's Forge integrates AI technologies from third-party providers, including OpenAI, Anthropic, and Google. When you use AI features:

• • Portions of your content may be sent to these third-party AI providers for processing
• • You are responsible for reviewing and approving any AI-generated content before use
• • AI-generated suggestions are provided as-is and should be verified for accuracy
• • AI features are optional and can be disabled entirely

We recommend reviewing the privacy policies of our AI providers if you have concerns about how your content is processed.

8. Prohibited Activities

You agree not to:

• • Use Author's Forge for any illegal purpose or in violation of any laws
• • Infringe upon the intellectual property rights of others
• • Attempt to gain unauthorized access to our systems or other users' accounts
• • Reverse engineer, decompile, or disassemble the software
• • Redistribute, resell, or sublicense the software without permission
• • Transmit malware, viruses, or other harmful code
• • Scrape, harvest, or collect data from our services without authorization
• • Interfere with or disrupt the integrity or performance of the services

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• • The services will be uninterrupted, error-free, or secure
• • Any defects will be corrected
• • The services will meet your specific requirements
• • Your data will not be lost (please maintain regular backups)

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTHORS FORGE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Our total liability for any claims arising from these Terms or your use of the services shall not exceed the amounts paid by you to Authors Forge LLC in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Authors Forge LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• • Your use of the services
• • Your content
• • Your violation of these Terms
• • Your violation of any third-party rights

12. Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the services shall be resolved through binding arbitration administered by JAMS in accordance with its rules. The arbitration shall take place in Phoenix, Arizona. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Termination

You may stop using Author's Forge at any time. We may terminate or suspend your access if you violate these Terms. Upon termination:

• • Your local files remain yours and accessible
• • You can export your content at any time
• • Premium features will be disabled
• • Account data may be deleted after a reasonable period

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide at least thirty (30) days' notice of material changes through the application or via email. Your continued use of the services after the effective date of any changes constitutes acceptance of the modified Terms.

15. General Provisions

• • Entire Agreement: These Terms constitute the entire agreement between you and Authors Forge LLC regarding the services.
• • Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
• • Waiver: Failure to enforce any right does not constitute a waiver of that right.
• • Assignment: You may not assign these Terms without our consent. We may assign our rights without restriction.
